Procurement & Contracting Principles for Facility Professionals


Facility Management has rapidly developed into a discipline, vocation and business service and the profession and job title is much more accepted and recognised in Trinidad and Tobago today than it was 10-15 years ago.

With that recognition has come greater responsibility for Facility Professionals and they are now required to execute and manage a multitude of contracts for the facilities which they manage including among those Building Maintenance, Waste Management, Security, Fleet Maintenance, Real Estate & Lease Management and managing outsourced services. In addition, they are also required to ensure that the organisation's facilities comply with all Occupational Health and Safety laws. With this in mind the continuing education of Facility Professionals in the areas of good contracting and procurement is now critical to them performing their tasks effectively and efficiently while at the same time mitigating risk for their organisations.

Target Audience

This workshop would be beneficial to Facility Managers/Professionals and other persons involved in the acquisition of services for the maintenance of facilities.

Learning Objectives

Upon successful completion of this workshop, participants should be able to:

  • Demonstrate and understanding of how binding contracts are formed and the remedies for breach of contract, including the documentation required to make a successful claim
  • Identify the statute laws that govern contracts in Trinidad and Tobago
  • Explain the effect of the OSH Act on owners and occupiers of business premises.
  • Read and interpret contract language and understand how to protect their organisation with suitable contract clauses.
  • Select, evaluate and measure suppliers and demonstrate how to disengage suppliers in a professional manner
  • Demonstrate an understanding of the laws governing tenders and how to deal with challenges to their tender procedures from unsuccessful tenderers
  • Effectively structure contracts for services
  • Demonstrate an understanding of ethical conduct for procurement and contracting individuals

  • The essentials of a binding contract
  • The Law of Agency and its effect on Facility Professionals
  • The remedies for breach of contract including self-help remedies
  • Contract clauses that protect your organisation
  • The law relating to tenders and how to effectively deal with challenges to your tender process
  • Writing an effective scope of work for services contracts with specific reference to building maintenance and janatorial contracts
  • The relevance of the OSH Act for Facility Professionals
  • Effective supplier selection, evaluation and appraisal
  • Measuring supplier performance
  • The effective use of insurance, bonds and guarantees when contracting
  • Effective contract management from RFQI to contract closeout
